HeyAlvie® and the HeyAlvie logo are registered trademarks of Invendar LLC. The mark is registered with the United States Patent and Trademark Office and with the State of New Jersey, Division of Revenue and Enterprise Services, pursuant to N.J.S.A. 56:3-13.1 et seq. Invendar LLC further claims common-law rights in the mark arising from use in commerce.
Federal registration constitutes nationwide constructive notice of ownership under 15 U.S.C. § 1072. Any unauthorized use, reproduction, imitation, or registration of this mark, or of any confusingly similar mark, name, domain, application name, handle, or logo in connection with related goods or services, constitutes trademark infringement under 15 U.S.C. § 1114 and false designation of origin and unfair competition under 15 U.S.C. § 1125(a). Registration of a confusingly similar domain name may additionally constitute cybersquatting under the Anticybersquatting Consumer Protection Act, 15 U.S.C. § 1125(d).
Infringement exposes the infringing party to injunctive relief under 15 U.S.C. § 1116 and to monetary liability under 15 U.S.C. § 1117, including the infringer's profits, damages sustained, costs of the action, and — in exceptional cases — treble damages and attorneys' fees.
Invendar LLC actively monitors for infringing use and enforces these rights. Where infringement is identified, we will pursue all available remedies without further warning, including cease-and-desist demands, domain seizure and transfer proceedings under the UDRP, takedown requests to hosting providers and to the Apple App Store and Google Play, opposition and cancellation proceedings before the Trademark Trial and Appeal Board, and civil action in federal court.
